Axar Properties do not hold 10% deposits and do not encourage the payment of deposits to sellers prior to a legally binding contract having been signed by both sellers and purchasers after the appointed lawyer has agreed that all of the enquiries required have been answered satisfactorily and Legal Title to the property can be confirmed as acceptable.

   Should you decide to proceed with your purchase from the UK then insofar as legal services are concerned our in-house lawyers are able to attend to the sale and purchase procedure up to completion in Spain by way of Power of Attorney. Please see below the link to Paula Basham’s firm Whiskers in the UK who are able to provide services not only in connection to the Power of Attorney for those in the UK unable to attend to legal matters in Spain but also for those who require a UK Will made and are unable to leave Spain.    Axar Properties are pleased to follow a similar purchase procedure to that in the UK by requiring the sellers to complete a standard list of enquiries and our lawyers will make the usual pre-contract enquiries of local authorities, ensuring that there are no charges registered against the property. Attending to “exchange of contracts” and “completion” procedure in a similar way that you are used to in the UK. Our lawyers will also correspond with you by email or letter keeping you up-dated throughout the sale and purchase procedure, as you are used to dealing with lawyers in the UK !!

   The property purchase system in Spain is regulated to a point, however, there could be a lifetime of difficulties for a prospective purchaser who seeks redress through the Court system for failing to make enquiries and/or relying upon verbal advice. You must be confident that the terms of your Contract are correct, understood and that your deposit is in safe hands !

   Paula has English speaking Spanish lawyers available Monday to Friday however should you only be able to attend to matters over a weekend an appointment can be made for you. Failing this when you return to the UK Whiskers Solicitors can prepare a Power of Attorney for you should you wish to appoint someone in Spain to attend to legal matters for you.

   Mortgage

Axar Properties SL has a panel of Banks recommended for their percentage of loan to value of property, customer service and quality of care. Please ask for more information. Mortgages can be obtained up to 100% of the value of the property at a low mortgage rate.

   Insurance

It is recommended that you obtain insurance from the date of completion ie. the day you sign your Title Deeds, the Escritura which will be signed at the Notary office. If you require more information relating to Buildings Insurance or Contents insurance please contact one of our offices for the telephone number of an English Insurance Agent offering competitive rates.
